Terms of Service
These terms of service are to ensure that the process remains both time and price efficient as well as enjoyable for all involved. Before commencement of a business relationship I will be requesting that you read, agree to and and sign these terms.
1. All work is taken on a payment in advance basis. This may seem a bit unusual but as a customer you have far more power over my not completing work than I have over you if you don't pay me when I have.
- Projects will generally be broken into parts with payment similarly broken up e.g. i) Strategy, ii) Structure and iii) Content to spread the load.
- Invoices need to be visibly paid no later than the morning of a scheduled meeting or any other work where time is of the essence.
- Payment will generally be made either by direct bank deposit or via a service like Pay Pal. If you wish to pay cash that is acceptable - please offer the cash at the beginning of the meeting to avoid embarrassment when I stop and ask.
- If you choose to cancel a project in mid-course then paid monies are not automatically refundable. BRM Web Consulting retains the right to invoice and receive compensation for any outstanding work and costs.
2. BRM Web Consulting is primarily a consulting service so we will both have responsibilities in the course of any project.
- Strategy is the major point of difference between my work and that of others. I will want to take plenty of time to discuss and build a specific strategy to suit the needs of you and your business. Everything you tell (or don't tell) me wil affect the outcome.
- Several meetings may be necessary to build the complete strategy and collateral for a project. I understand that at times this can seem like little 'visible' work is happening but please be patient as the planning stage will mean that when we start building the results will come quicker and with fewer revisions. Your involvement at this stage is very important as it defines the success of the whole project. It also help you learn new skills.
- Each part of a project cannot proceed till the proceeding part is fully completed. Attempts to force projects to proceed will be resisted. Ultimately it will be your choice if you want to go ahead when foundation work is incomplete.
- I will often give you homework. It is up to you to complete this. Homework is work that either I cannot realistically do myself or that (esp. in the case of Tuition) you have chosen to be responsible for. Non-completion of homework will most often hamper or stall us as we attempt to move forward. Not providing information, initial documents, logos and images will prevent work from proceeding.
- Reasonable attempts will be made to alert you to missing information or elements. If you choose not to provide the required information, documents, logos and images I cannot be responsible for delays.
- Ultimately it will be your choice if you want to go ahead when foundation work is incomplete. Short-changing the planning process will diminish the results for all and I will take no responsibility for delay or failed projects when foundation work is skipped.
- Once specific work or part of a project is approved then requests to revisit, alter or rearrange that work will incur extra fees.
3. Meetings. Working with me and BRM Web Consulting will require a few meetings
- Meetings will generally be conducted at either your place of business, via a service like Skype or a mutually agreed location like a coffee shop. If in a coffee shop please be sure to pay for your food and drink.
- If you want to use a computer/internet connection during a meeting please bring your own.
- Meetings will be arranged for specific times. If you cannot meet these arrangements then please alert me early. Cancellations within 48 hours will not be refunded unless I can fill the time with other equally paying work.
- If you run late for a meeting or choose to take interruptions during the meeting then your meeting will not be extended. If you meet me at your work it is best to alert staff that you are out of communication for the two hours of our meeting.
- If you require me to travel long distance for meetings (eating up time, fuel and my CDs) then I reserve the right to add a premium to your fees of generally $20 per hour over the first 1/2 hour from the Brisbane CBD. Check with me in advance to see if I need to charge this.
4. Artwork and other Structure
- Pre-built templates are stock artwork built by myself and BRM Web Consulting. This means that there may be several sites published with the same core template artwork. If this is a concern to you then please consider custom artwork.
- All work including artwork and I.T. is quoted on standard times and understanding reached at the briefing stage. If the brief changes or more than two (2) revisions are requested, extra fees will need to be charged before work can proceed. Simply put, I will keep my promises and expect you to do the same.
- Unless specified, once fully paid, any original artwork, IT or similar structure developed for a project becomes property of the paying customer.
- Please feel free to ask for source files as I and BRM Web Consulting will file work but ultimately take no responsibility for files lost in storage loss situations like hard drive failures.
- While I am happy to pass over most working files on request, other companies (outsoerced work) may reserve the right to keep source files and I cannot speak for them as every company reserves their own rights to their I.P. and work.
- If unpaid work is used in public then I and BRM Web Consulting reserves the right to sue for payment and damages. This is an un-cool thing to do so I hope you never give in to temptation and place us in such an ugly position.
5. Non Disclosure, Competition and Fair Trading. I am a great believer in free enterprise, competition and the rights to genuine free trade.
- Information about your business and activities that is not public knowledge (published in any way, e.g. web site, email marketing or similar) will not be passed on to anyone outside of your organization without authorization. Generally I will not identify your company as a client until work is published.
- At times it will be necessary for your project to be handled by third party developers and other service providers. It is assumed that these providers will also work under an environment of non-disclosure and respect. I cannot be responsible for actions of a third party company.
- Any attempts by un-recognized parties to access information about you and your company will be resisted. If you wish to appoint a new contact, please inform me with a clear authority first to avoid the new relationship starting on the wrong foot.
7. If at any stage you feel confused or in any way unhappy with the way things are progressing between us then do us both the honor of discussing the matter with me alone before taking drastic action.
